Lead Regulations in Iowa

EPA Real Estate Disclosure Rule

This law pertains the sale and lease of pre-1978 housing. A seller/lessor must disclose any specific knowledge of lead based paint and lead based paint hazards in the property. This rules requires completion of a standard form and provision of a lead pamphlet to the buyer or lessee. The Iowa brochure may be used (in Iowa) for compliance with this regulation or the EPA brochure may be used. The EPA is the enforcement agent for this regulation and violators may be subject to penalties up to $11,000.00 per violation.

Renovation, Remodeling,and Repainting Lead Hazard Notification Process - (IAC 641-69)

"This chapter applies to all persons who perform renovation, remodeling, or repainting for compensation in target housing or a child-occupied facility." This requires contractors to provide a written notice and pamphlet prior to beginning any work that will disturb a painted surface. The Iowa brochure may be used (in Iowa) or the EPA brochure. The Iowa Department of Public Health is the enforcement agent for this regulation within the State of Iowa and violators are subject to penalties up to $5000.00 per violation.

Lead Paint Professionals - (IAC 641-70)

"This chapter applies to all persons who are lead professionals in Iowa, all firms that perform lead professional activities in Iowa, and training providers that offer training for lead professionals. This chapter requires lead professionals and firms to be certified and establishes specific requirementsfor how lead-based paint activities must be performed if a property owner, manager, or occupant chooses to undertake them. However, nothing in this chapter requires a property owner, manager, or occupant to undertake any particular lead-based paint activity. This chapter also provides for the approval of courses that provide training for lead professionals. "
